INSTRUCTIONS ON THE RIGHT TO WITHDRAW FROM A DISTANCE CONTRACT

1. The Customer has the right to withdraw from this contract within 14 days from the date of receipt of the shipment without giving any reason and without incurring any costs, except for the costs of delivering the goods the EARLY STAGE.
2. EARLY STAGE is not obliged to reimburse to the Customer any additional costs incurred by the Customer.
3. The deadline to withdraw from the contract expires after 14 days from the date of receipt of the parcel.
4. For the contract withdrawal to be effective, EARLY STAGE must receive a written statement of withdrawal from the contract.
A declaration of withdrawal from the contract and proof of purchase should be attached to the returned goods, the order number should be provided and the goods should be then immediately returned in a non-deteriorated condition to the EARLY STAGE to the following address:

6. To meet the 14-day deadline, it is sufficient to send a statement before it lapses.
7. Immediately after receiving your statement of withdrawal from the Contract, EARLY STAGE will send a confirmation of its receipt to the e-mail address provided for this purpose.
8. The refund shall be made no later than 14 days after the EARLY STAGE has received the returned goods, using the same payment method as used by the Customer.
9. Returned goods must not bear traces of use. It must be intact.
10. In the case of damage, destruction, use of the product, the Consumer is not entitled to withdraw from the contract.
11. The use of activation codes for the Grammar Rhymes platform and for the Application is equivalent with the use of the Product.

The e-mail address will be processed as personal data, based on your consent [Article 6(1)(a) of the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC – “GDPR”]. Personal data will also be processed because it is necessary to fulfil the legally justified purposes pursued by ES EDUCATION Bochińska i Wspólnicy Spółka Komandytowa in relation to the establishment, enforcement or defense of potential claims [pursuant to Article 6(1)(f) of the GDPR].

Personal data is stored until the consent is revoked or ES EDUCATION stops sending marketing information. Consent to its processing may be revoked at any time by marking the opt out option in the received e-mail with marketing information; this will not have any impact on the lawfulness of processing conducted before the withdrawal of the consent (taking into account the relevant statutory period of limitation dates).

You have the right to access your personal data, rectify it, delete it (“right to be forgotten”) and restrict its processing, as well as the right to have the data transferred to another controller and to lodge a complaint with the President of Personal Data Protection Office. You also have the right to object against the processing [if the processing is based on Article 6(1)(f) of the GDPR].

These rights, except for lodging a complaint with a supervisory authority, may be exercised by sending a request to the e-mail address: d.osobowe@earlystage.pl or in another manner selected by you.

Providing your personal data is voluntary, it is not required by law, but failure to provide the data will prevent you from receiving marketing information from ES EDUCATION. No automated decisions shall be made based on the personal data, and profiling will not be used.

ES EDUCATION also informs that personal data is processed with the use of the services of Facebook Inc. with its registered office in the United States of America and Facebook Limited with its registered office in Ireland as the processor and the data is transferred to a country outside the European Economic Area, namely to the United States of America. Such a transfer is possible, as the privacy policies or other personal data protection rules of the abovementioned data recipients invoke standard data protection clauses adopted by the European Commission. Information on personal data processing rules applicable to the abovementioned portals is available in the personal data protection documents that can be found on their websites.

ES EDUCATION also informs that personal data is processed with the use of the services of Google LLC as a processor, and therefore the data is transferred to a country outside the European Economic Area, namely to the United States of America. Such a transfer is admissible, as the privacy policies or other personal data protection rules of Google LLC invoke standard data protection clauses adopted by the European Commission.
